Peppery Spot is the trading name used for this online store by Horváth András EV, a sole proprietor registered in Hungary. Throughout these Terms of Service, the terms “Peppery Spot”, “we”, “us” and “our” refer to Horváth András EV operating under the Peppery Spot name.

Peppery Spot operates this website and online store, including the information, content, features, tools, products and services made available through it (collectively, the “Services”). Our store is powered by Shopify, which provides the e-commerce platform that enables us to offer the Services.

These Terms of Service (“Terms”) govern your access to and use of the Services and purchases made through Peppery Spot. Our Privacy Policy, Return and Refund Policy, Delivery Information and any other policies expressly referred to in these Terms form part of the conditions applicable to your use of the Services and purchases from us.

Please read these Terms carefully before using our website or placing an order. By accessing the Services or placing an order, you agree to be bound by these Terms to the extent permitted by applicable law.

Nothing in these Terms is intended to exclude, restrict or reduce any mandatory rights available to consumers under applicable consumer protection law.

SECTION 2 – ELIGIBILITY AND CUSTOMER ACCOUNTS

The Peppery Spot online store is intended for customers aged 18 years or older.

By placing an order, you confirm that you are at least 18 years old and have the legal capacity required to enter into the transaction.

A customer account is not required in order to place an order. Customers who create an account may have access to additional conveniences, features or benefits offered by Peppery Spot from time to time. Such features may be modified or discontinued without affecting orders already concluded.

You are responsible for maintaining the confidentiality and security of your account credentials and for information submitted through your account.

SECTION 3 – PERSONAL AND HOUSEHOLD PURCHASES

Peppery Spot primarily serves individual consumers purchasing products for personal or household use.

Products are supplied in quantities that we consider reasonable for normal personal or household consumption. We reserve the right to limit quantities, refuse an order or cancel quantities that reasonably appear to exceed normal household requirements or indicate purchasing for commercial resale, distribution or other commercial purposes.

Peppery Spot does not offer VAT-exempt intra-Community business purchasing through the online store. The availability of a company name, tax number or other business information field during checkout does not constitute an offer of VAT-free or wholesale purchasing.

SECTION 4 – PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, specifications and other information displayed in the store are accurate and useful.

However, manufacturers may change packaging, labels, artwork, product presentation, dimensions, ingredients, formulations or other product characteristics without prior notice to retailers.

Product photographs may therefore show an earlier or different version of the manufacturer's packaging. A change in packaging, label design, artwork or other non-material presentation characteristic does not by itself mean that an incorrect or defective product has been supplied.

Manufacturers may also replace an existing product with an updated or successor version, including changes to its formulation or ingredients. Where a product continues to be marketed by the manufacturer as the same product or its direct successor, the version supplied may differ from photographs or information originating from an earlier production version.

This does not affect any mandatory rights you may have where the goods supplied do not conform to the sales contract under applicable law.

Customers with allergies, intolerances, sensitivities, dietary restrictions or other requirements should always examine the information printed on the actual product packaging before use or consumption. The information on the physical product should be treated as the most current manufacturer-provided information.

Colors and appearance may also vary depending on screen, device and display settings.

SECTION 5 – AVAILABILITY

All products are subject to availability.

Inventory information is maintained with reasonable care, but discrepancies may occur, including as a result of simultaneous orders, stock damage, inventory errors, supplier changes or technical issues.

The presence of a product on the website or the ability to add it to the cart does not constitute a guarantee that the product will remain available until an order has been accepted and processed.

We reserve the right to discontinue products or restrict availability at any time.

SECTION 6 – PLACING AN ORDER AND FORMATION OF THE CONTRACT

By submitting an order through Peppery Spot, you make an offer to purchase the products contained in that order at the prices and on the terms displayed at the time of submission.

After the order is submitted, you will normally receive an automatically generated order confirmation email. This email confirms that our system has received your order. It does not, by itself, constitute acceptance of your offer.

Payment authorization, reservation or collection of funds also does not by itself require Peppery Spot to accept an order.

Peppery Spot accepts an order when we begin processing it for fulfilment, including allocating, picking or packing the products for dispatch. No separate acceptance email is required. A later fulfilment or tracking notification confirms that the order has progressed to shipment processing.

Before acceptance, we reserve the right to decline an order in whole or in part, including where:

• a product is unavailable;
• stock information was incorrect;
• an obvious pricing, description or technical error occurred;
• payment cannot be verified or processed;
• an order is identified as potentially fraudulent or otherwise presents a security concern;
• the delivery address is incorrect, incomplete, inconsistent or unsuitable for courier delivery;
• the address is a PO Box or equivalent;
• the destination is not supported by our carriers;
• carrier restrictions, import restrictions or other legal or operational restrictions apply;
• the order exceeds reasonable personal or household quantities;
• additional remote-area or special delivery charges apply and are not accepted by the customer; or
• another circumstance makes fulfilment impossible, unlawful or commercially impracticable.

Where payment has already been collected for an order that we do not accept, the relevant amount will be returned using the appropriate payment method.

Where performance becomes impossible after acceptance for a reason recognised by applicable law, we may cancel the affected order or item and refund the amount due.

SECTION 7 – PRICES, VAT AND PAYMENT

Product prices and promotions may change without notice. The price applicable to an order is generally the price displayed at the time the order is submitted, subject to correction of obvious pricing or technical errors where permitted by law.

For customers within the European Union, the final product price displayed at checkout includes applicable VAT where required.

Peppery Spot does not provide VAT-exempt intra-Community purchasing through the online store.

Shipping charges are calculated according to the destination, shipment characteristics and the delivery options available at checkout.

For deliveries outside the European Union, customs duties, import VAT, brokerage charges, customs processing fees and other taxes or charges may be imposed by the destination country or its authorities.

Unless expressly stated otherwise, such charges are not included in Peppery Spot product prices or shipping charges and are the responsibility of the recipient.

Customers are responsible for familiarising themselves with the import and customs requirements applicable in their country before ordering.

SECTION 8 – DELIVERY DESTINATIONS AND SHIPPING CHARGES

Peppery Spot delivers only to destinations for which a shipping option is made available by us.

Because available services, charges, weight limits and delivery conditions differ by destination and may change, the current information shown at checkout and our Delivery Information page applies:

Where there is a difference between a general shipping statement elsewhere on the website and the delivery options specifically made available for the customer's destination at checkout, the checkout information applicable to that order will take precedence, subject to mandatory law.

The availability of a country or region in an address selector does not necessarily guarantee that every address within that territory can be serviced.

SECTION 9 – ADDRESS REQUIREMENTS

Customers are solely responsible for providing a complete, accurate and deliverable shipping address when placing an order.

Please carefully verify the recipient's:

• full name;
• street name;
• house or building number;
• apartment, unit or other required address information;
• postal code;
• city;
• country;
• telephone number; and
• email address

before submitting the order.

Due to the volume of orders we process, Peppery Spot cannot undertake to individually investigate, correct or obtain missing delivery information for every order.

If an address appears incomplete, incorrect, contradictory or unsuitable for delivery, we reserve the right to reject or cancel the order rather than request additional information from the customer.

PO Boxes

Peppery Spot provides door-to-door courier delivery only.

We do not ship to PO Boxes, postal collection boxes or equivalent addresses. Attempting to enter a PO Box using alternative formatting, abbreviations, additional characters or other methods does not make the address eligible for delivery.

Orders addressed to a PO Box or equivalent location may be rejected or cancelled.

SECTION 10 – REMOTE AND SPECIAL DELIVERY AREAS

Courier companies may classify certain postal codes, islands, rural areas, geographically isolated locations or other destinations as remote, extended or special service areas and may apply additional charges.

These classifications are determined by the relevant carrier and may change at any time.

Peppery Spot does not maintain or control the carriers' complete remote-area databases and cannot guarantee that every remote-area classification will be identified automatically during checkout.

If, during shipment preparation, a carrier identifies the customer's address as subject to an additional remote-area or similar surcharge that was not included in the original checkout shipping rate, we may place the shipment on hold and contact the customer by email.

Where applicable, an invoice for the additional delivery charge will be sent to the email address provided with the order.

The customer may then choose to pay the additional amount or, where the order has not yet been dispatched, request cancellation of the affected order.

Peppery Spot is not required to provide a delivery service at the original standard shipping rate where that service is not actually available for the customer's address under the carrier's applicable classification.

SECTION 11 – ORDER CHANGES AND CANCELLATION REQUESTS

Customers may request cancellation or correction of an order before shipment processing has progressed beyond the point at which a change can reasonably be made.

We will make reasonable efforts to accommodate a request received in time, but cancellation or modification cannot be guaranteed once fulfilment has begun.

Once a tracking number has been generated and the shipment has entered the carrier's processing system, Peppery Spot can no longer guarantee cancellation of the shipment or modification of the delivery address.

Customers must therefore verify all order and delivery information before submitting the order.

Tracking and shipping notifications are sent to the email address supplied by the customer. The customer is responsible for providing an accurate and accessible email address and for checking communications relating to the order, including spam or filtered folders where appropriate.

A customer's inability to locate or receive an automatically transmitted tracking email does not by itself reverse shipment processing or restore the ability of Peppery Spot to cancel or modify a shipment that has already entered the carrier's system.

Nothing in this section limits any mandatory statutory right of withdrawal that applies after delivery.

SECTION 12 – DELIVERY TIMES AND TRACKING

Any delivery date, delivery window or transit time displayed by Peppery Spot is an estimate unless expressly stated otherwise.

International transportation may be affected by circumstances including customs processing, carrier operations, weather, public holidays, strikes, transportation disruptions, security checks and other events outside our reasonable control.

Where tracking is available, Peppery Spot provides tracking information so that customers can follow the progress of their shipment.

Carrier tracking may display the expected delivery date and, where supported by the carrier, an estimated delivery time window.

Customers are expected to monitor the shipment and make reasonable arrangements to enable delivery.

Mandatory statutory delivery rights remain unaffected.

SECTION 13 – DELIVERY, CUSTOMER AVAILABILITY AND UNCOLLECTED SHIPMENTS

The customer is responsible for taking reasonable steps to enable successful delivery at the shipping address provided with the order.

Where tracking information identifies an expected delivery date or delivery window, the customer should ensure that either the recipient, another authorised person or another arrangement accepted by the carrier is available for delivery.

If nobody can receive the parcel, the customer is responsible for following the carrier's available procedures, where applicable, to arrange redelivery, collection or another delivery option.

Failure to accept, collect or facilitate delivery does not by itself constitute a valid exercise of the statutory right of withdrawal.

Where a shipment cannot be delivered or is returned because of circumstances attributable to the customer, including:

• refusal or repeated failure to accept delivery;
• failure to collect a shipment;
• failure to respond to or act upon carrier delivery instructions;
• an incorrect or incomplete address supplied by the customer;
• an inaccessible delivery location;
• failure to provide information required for delivery or customs clearance; or
• another avoidable circumstance attributable to the recipient,

Peppery Spot reserves the right, to the fullest extent permitted by applicable law, to recover or deduct the actual costs and losses resulting from the failed delivery.

These may include outbound transportation, return transportation, carrier surcharges, storage, customs-related charges, handling charges and other costs directly caused by the unsuccessful delivery.

Any amount that Peppery Spot is legally entitled to recover may be deducted from amounts otherwise repayable to the customer. Where the law does not require reimbursement of an amount, no reimbursement will be due.

This section does not limit the customer's mandatory rights where non-delivery results from circumstances attributable to Peppery Spot or where the customer has validly exercised a statutory right available under applicable law.

SECTION 14 – PASSING OF RISK

Where Peppery Spot arranges delivery to a consumer, the risk of loss of or damage to the goods passes in accordance with applicable consumer protection law.

For EU consumers, this will generally occur when the consumer, or a third party designated by the consumer other than the carrier, obtains physical possession of the goods.

This does not remove the customer's responsibility for losses or costs lawfully attributable to the customer's own acts or omissions, including failure to provide a deliverable address or reasonably facilitate delivery.

SECTION 15 – RIGHT OF WITHDRAWAL FOR EU CONSUMERS

Consumers entitled to the statutory EU right of withdrawal may withdraw from an eligible distance purchase within the applicable statutory period, generally 14 days from receipt of the goods, without giving a reason.

Where applicable law allows withdrawal to be communicated through another valid and unequivocal statement, use of the online form does not remove that statutory option.

After communicating withdrawal, the customer must return the goods within the applicable statutory period.

Unless Peppery Spot expressly agrees otherwise or applicable law requires otherwise, the direct cost of returning goods is borne by the customer.

The customer is responsible for handling goods only to the extent necessary to establish their nature, characteristics and functioning. Peppery Spot may claim any legally recoverable reduction in value resulting from handling beyond what is necessary for that purpose.

The statutory right of withdrawal does not apply where an exception provided by applicable law applies. This may include, among other cases:

• goods liable to deteriorate or expire rapidly; and
• sealed goods which are not suitable for return for genuine health-protection or hygiene reasons where the seal has been broken after delivery.

Whether a particular product falls within a statutory exception depends on the nature and condition of that product and the applicable law.

SECTION 16 – INCORRECT, DAMAGED OR NON-CONFORMING GOODS

If Peppery Spot supplies a materially different product from the product ordered, or if goods otherwise fail to conform to the sales contract, the customer retains the remedies provided by mandatory applicable law.

Depending on the circumstances and the remedy available under applicable law, Peppery Spot may resolve a verified issue through replacement, reimbursement or another appropriate remedy.

A manufacturer's packaging update, artwork change, label redesign or other non-material packaging difference does not by itself constitute delivery of the wrong product.

Minor damage to outer packaging or minor physical changes that do not materially affect the product's safety, quality, functionality or usability do not automatically establish that the goods lack conformity. Each reported issue may be assessed based on the nature and extent of the alleged defect or damage.

Where a product is damaged to an extent that materially affects its contents, safety, usability or conformity, the customer should contact Peppery Spot and provide reasonable evidence of the issue.

Nothing in this section limits mandatory statutory conformity, guarantee or warranty rights.

SECTION 17 – CUSTOMER RESPONSIBILITY FOR PRODUCT USE

Products must be used, stored and handled in accordance with the manufacturer's instructions, warnings and intended purpose.

The customer is responsible for reviewing product labels and manufacturer information before use.

In particular, customers with allergies, intolerances, sensitivities or specific dietary or health-related requirements should verify the ingredients, warnings and other information on the actual packaging received before using or consuming the product.

Information displayed on Peppery Spot is intended to assist customers but does not replace mandatory manufacturer labelling or professional advice where such advice is appropriate.

SECTION 18 – ERRORS AND CORRECTIONS

Despite reasonable care, the website may occasionally contain typographical errors, inaccurate product information, incorrect stock information, pricing errors, shipping calculation errors or other technical inaccuracies.

We reserve the right to correct such errors as soon as reasonably practicable.

Where an error is identified before an order has been accepted, we may refuse the affected order.

Where an error is discovered after acceptance, the matter will be handled in accordance with applicable law and the circumstances of the order.

Nothing in these Terms requires Peppery Spot to honour an obvious error where applicable law permits correction or cancellation.

SECTION 19 – THIRD-PARTY SERVICES AND LINKS

The Services may include links to or functionality provided by third parties, including payment providers, couriers, technology providers, social platforms and other external services.

Where you follow a link to an independent third-party website or service, that third party may apply its own terms, privacy practices and policies.

Peppery Spot does not control independent third-party websites and is not responsible for their general availability, content or independent practices.

This section does not exclude responsibility that Peppery Spot is required by law to retain for services used by us in performing our obligations to you.

SECTION 20 – RELATIONSHIP WITH SHOPIFY

Peppery Spot is powered by Shopify, which provides the e-commerce technology used to operate the online store.

Purchases made from Peppery Spot are transactions between the customer and Horváth András EV operating as Peppery Spot, not purchases from Shopify.

Shopify is not the seller of the products offered by Peppery Spot.

Your use of Shopify-powered functionality may involve processing of information by Shopify in accordance with the applicable privacy arrangements described in our Privacy Policy and Shopify's own applicable privacy documentation.

SECTION 21 – PRIVACY

Personal information collected through Peppery Spot is processed in accordance with our Privacy Policy and applicable data protection law.

Information may also be processed by service providers used to operate the store and fulfil orders, including Shopify, payment providers, delivery companies and other processors or service providers where necessary.

Please review the Privacy Policy for further information regarding the collection, use, storage and processing of personal information.

SECTION 22 – REVIEWS, FEEDBACK AND CUSTOMER CONTENT

If you voluntarily submit a review, photograph, comment, recommendation, feedback or other content to Peppery Spot, you confirm that you have the right to provide that content and that it does not unlawfully infringe the rights of another person.

Unless you tell us that you do not want such use, you grant Peppery Spot a non-exclusive, worldwide, royalty-free right to reproduce, display, format and use the submitted content in connection with the Peppery Spot store, its product pages, customer communications and promotional or marketing activities.

Where reasonably practicable, you may contact us at info@pepperyspot.com if you do not want your submitted content used for future promotional purposes.

We may moderate, refuse or remove customer-submitted content where we reasonably consider it unlawful, misleading, abusive, offensive, fraudulent, infringing or otherwise inappropriate for publication.

You remain responsible for the content you submit.

SECTION 23 – INTELLECTUAL PROPERTY AND PERMITTED AUTOMATED ACCESS

The Peppery Spot website contains material owned by, licensed to or lawfully used by Peppery Spot as well as material associated with third-party manufacturers and brands.

All third-party trademarks, trade names, product names, logos and other proprietary identifiers remain the property of their respective owners. Their appearance on Peppery Spot does not imply ownership of those rights by Peppery Spot.

Any rights in original Peppery Spot website elements, layout, original text, graphics, compilations or other materials belong to Peppery Spot or the relevant rights holder, as applicable.

Nothing in these Terms transfers any intellectual property right to a visitor or customer.

Search engines, shopping services and AI agents

Peppery Spot does not seek to prevent legitimate indexing, product discovery, search, comparison-shopping or AI-assisted shopping services from accessing publicly available information where such access is technically permitted and carried out lawfully.

However, automated systems, agents, crawlers or other users must not:

• circumvent access controls, security measures, CAPTCHAs or technical restrictions;
• impersonate a human user where identification as an automated system is required;
• interfere with or materially impair the operation, security or availability of the Services;
• extract or reproduce substantial portions of the website or product database for unauthorised republication or competing commercial use;
• systematically copy content in a manner that infringes applicable intellectual property, database or other rights;
• collect personal information without a lawful basis; or
• use the Services for fraudulent, malicious or unlawful purposes.

Peppery Spot may use reasonable technical measures to protect the website against abusive, excessive or harmful automated access without intending to prevent legitimate search, discovery or shopping functionality.

SECTION 24 – PROHIBITED USE

You may use the Services only for lawful purposes.

You must not use the website or Services to:

• commit or facilitate unlawful or fraudulent activity;
• interfere with website security or operation;
• introduce viruses, malicious code or other harmful technologies;
• obtain unauthorised access to accounts, systems or information;
• submit deliberately false or misleading information;
• impersonate another person;
• misuse another person's personal information;
• infringe intellectual property or other legal rights;
• engage in abusive automated extraction contrary to Section 23; or
• otherwise use the Services in a manner that causes unlawful harm to Peppery Spot or another person.

We reserve the right to restrict access, reject orders or take other reasonable measures where necessary to protect the Services, customers or Peppery Spot from unlawful or abusive activity.

SECTION 25 – DISCLAIMER AND LIMITATION OF LIABILITY

Peppery Spot does not exclude or restrict liability where such exclusion or restriction is prohibited by applicable law.

Nothing in these Terms excludes or limits mandatory consumer rights, statutory conformity rights or liability that cannot legally be excluded.

Subject to those mandatory rights, Peppery Spot is not responsible for loss arising solely from circumstances outside our reasonable control or from the customer's failure to comply with obligations reasonably necessary for the performance of the contract.

Peppery Spot is not responsible for indirect or consequential loss to the extent such liability may lawfully be excluded and where such loss was not reasonably foreseeable in connection with an ordinary consumer purchase.

Information provided through the website is offered in connection with the sale and use of the products and should not be interpreted as professional medical, nutritional, legal or other specialist advice.

SECTION 26 – SUSPENSION OR TERMINATION OF ACCESS

We may restrict or terminate access to the Services where reasonably necessary because of unlawful use, fraud, security threats, misuse of the website or material violation of these Terms.

Termination or restriction of website access does not affect rights or obligations arising from orders already concluded except where applicable law permits otherwise.

SECTION 27 – SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will apply only to the maximum extent permitted by law and, where necessary, will be treated as severed from the remaining Terms.

The validity and enforceability of the remaining provisions will not be affected.

SECTION 28 – NO WAIVER

If Peppery Spot does not immediately exercise or enforce a right available under these Terms or applicable law, this does not mean that the right has been waived.

A waiver relating to one particular circumstance does not constitute a waiver in another circumstance unless expressly stated.

SECTION 29 – GOVERNING LAW

These Terms and contracts concluded with Peppery Spot are governed by the laws of Hungary, subject to applicable mandatory consumer protection rules.

Where a consumer is entitled under applicable law to mandatory protection that cannot validly be excluded by a contractual choice of Hungarian law, nothing in these Terms deprives that consumer of such protection.

Any dispute will be dealt with by the courts or other competent bodies having jurisdiction under applicable law.

SECTION 30 – CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in law, business operations, technology, the Services or our policies.

The current version will be made available on this page together with its most recent update date.

Changes do not retroactively alter rights and obligations arising from orders already concluded except where required or permitted by applicable law.

SECTION 31 – OTHER PEPPERY SPOT POLICIES

These Terms should be read together with the other policies applicable to the Services, including our:

• Delivery Information; and
• EU Withdrawal Form and related withdrawal information.

Where a policy contains more specific provisions concerning the subject it covers, those specific provisions apply together with these Terms, subject always to mandatory applicable law.

SECTION 32 – LANGUAGE VERSIONS

Peppery Spot may make these Terms available in several languages for the convenience of customers.

The different language versions are intended to communicate the same substantive terms and should be interpreted consistently wherever reasonably possible.

Mandatory rights arising under applicable law are unaffected by the language in which these Terms are made available.
